Procurement policy
1. General Provisions
1.1. These e-shop rules (hereinafter – Rules) are a legally binding document for the Buyer and the Seller (hereinafter – Seller), which sets out the rights and obligations of the Parties.
1.2. The Seller reserves the right to change, amend or supplement these Rules at any time. The Buyer will be informed about changes to the Rules on the e-shop website.
2. Conclusion of the Purchase and Sale Agreement
2.1. The purchase and sale agreement between the Buyer and the Seller is considered concluded when the Buyer forms and submits an order for goods in the e-shop, having previously familiarized themselves with these rules.
3. Rights of the Seller
3.1. In the event of important circumstances, the Seller may temporarily or permanently suspend the operation of the e-shop without prior notice to the Buyer.
3.2. If the Buyer attempts to damage the operation, stability, and security of the e-shop or violates their obligations, the Seller has the right to restrict or suspend their ability to use the e-shop without warning.
4. Obligations of the Seller
4.1. The Seller undertakes to provide the opportunity to use the services of the e-shop, the operating conditions of which are set out in these Rules.
4.2. The Seller undertakes to deliver the goods purchased by the Buyer using the delivery method chosen by the Buyer, based on the conditions set out in these purchase and sale Rules.
4.3. If, due to unforeseen circumstances, the Seller cannot deliver the goods ordered in the e-shop, the Seller has the right to terminate the Purchase and Sale Agreement after informing the Buyer. The Seller may offer an analogous item. If the Buyer refuses, the Seller undertakes to refund the paid money within 3 working days.
4.4. If the Buyer exercises the right provided for in clause 5.2 of the Rules, the Seller undertakes to refund the money paid by the Buyer within 5 (five) working days from the date of receipt of the returned goods.
4.5. The Seller may withhold reimbursement until the goods have been returned to the Seller or the Buyer provides proof of having sent back the goods, whichever is the earliest.
5. Rights of the Buyer
5.1. The Buyer has the right to purchase goods in the e-shop in accordance with these Rules.
5.2. The Buyer has the right to withdraw from the purchase and sale agreement concluded in the e-shop by notifying the Seller in writing no later than within 14 (fourteen) calendar days from the date of delivery of the goods.
5.3. The Buyer may exercise the right mentioned in clause 5.2 only if the goods have not been damaged or their appearance has not substantially changed, and if they have not been used.
6. Obligations of the Buyer
6.1. The Buyer must pay for the purchased goods and accept them in the manner prescribed by these Rules.
6.2. If the Buyer, at the time of goods delivery, refuses to accept the goods without good reason, the Buyer must cover the return shipping costs at the Seller's request.
6.3. Upon delivery of the goods to the Buyer, the Buyer must check the condition of the shipment and the item(s) together with the Seller or the person who delivered the shipment.
6.4. By using the e-shop, the Buyer confirms that they agree with these purchase and sale rules and must comply with them.
7. Prices of Goods
7.1. The prices of goods in the e-shop are indicated in euros. Prices are inclusive of VAT. After confirming the order, a delivery fee, if applicable, is added to the total amount of goods.
8. Ordering and Payment for Goods
8.1. The Buyer, upon visiting the e-shop, selects the goods they like and adds them to the shopping cart. After forming the shopping cart, the Buyer enters personal data necessary for the order fulfillment: their name, surname, address to which the goods will be delivered, phone number, and additional information that may be important for delivering the ordered goods. The Buyer confirms that they have read these rules and confirms the order.
8.3. Payments can be made using Swedbank, Seb, Luminor, Citadele, Šiaulių bankas electronic banking services, and Visa / MasterCard payment cards. Payments are possible in euros. Payments are processed using the MakeCommerce.lt payment platform.
9. Delivery of Goods
9.1. When ordering goods, the Buyer must specify the exact delivery address for the goods.
9.2. The Buyer must accept the goods themselves. If the Buyer cannot accept the goods themselves, but the goods are delivered to the address specified by the Buyer, the Buyer has no right to make claims regarding the delivery of goods to an unsuitable person.
9.3. The Seller delivers the goods to the Buyer in accordance with the terms specified in the product descriptions.
9.4. The characteristics of all sold goods are specified in the description for each item. The Seller is not responsible for the fact that the color, shape, or other parameters of the goods in the e-shop may not match the actual size, shape, and color of the goods due to the characteristics of the monitor used by the Buyer.
9.5. If the Buyer cancels the purchase and sale agreement, all amounts paid by the Buyer, including the delivery costs paid by the Buyer, are refunded to the Buyer.
10. Exchange of Goods
10.1. Quality goods can be exchanged within 14 days from the date of their receipt. Defects of substandard goods are rectified, and substandard goods are exchanged, in accordance with the provisions of the Civil Code of the Republic of Lithuania.
10.2. The following conditions must be met when exchanging goods:
10.2.1. The exchanged goods must be in their original, undamaged packaging (this point does not apply when substandard goods are exchanged);
10.2.2. The goods must not be damaged by the Buyer;
10.2.3. The goods must be unused, and their commercial appearance must not have been lost: labels intact, protective films not torn off, etc. (this point does not apply when substandard goods are exchanged);
10.2.4. The exchanged goods must be of the same completeness as received by the Buyer (this point does not apply when substandard goods are exchanged);
10.2.5. The Seller has the right to refuse to accept goods exchanged by the Buyer if the conditions for goods exchange were not complied with;
10.2.6. Goods exchange is carried out by the method determined by the Seller within 14 (fourteen) days from the date of receipt of the goods (this point does not apply when the goods are substandard – in this case, goods exchange is carried out within the statutory warranty period);
11. Final Provisions
11.1. These Rules are drawn up in accordance with the legal acts of the Republic of Lithuania.
11.2. These Rules and the relations between the Parties in respect of these Rules shall be governed by and interpreted in accordance with the laws of the Republic of Lithuania.
11.3. All disagreements arising from the implementation of these Rules shall be resolved through negotiations. If an agreement cannot be reached, disputes shall be settled in the manner prescribed by the laws of the Republic of Lithuania.
11.4. The Parties are released from the fulfillment of obligations under these Rules if they cannot be fulfilled due to unforeseen circumstances beyond the control of the Parties (Force majeure).
